If you do not agree with any provision herein, please do not engage our services.
2. Freight Brokerage & Carrier Relationships
- Role of IJR Logistics: IJR Logistics LLC functions as a licensed property freight broker registered with the Federal Motor Carrier Safety Administration (FMCSA) and Federal Maritime Commission (FMC). We contract with authorized, safety-vetted motor carriers, rail entities, and ocean liners to perform transportation movements.
- Bill of Lading (BOL): The terms and conditions of the specific standard uniform Bill of Lading issued for each shipment shall govern the physical transportation of the cargo. In the event of a conflict, these Terms shall take precedence.
3. Shipper Obligations & Hazardous Declarations
- Packaging & Labeling: The shipper is strictly responsible for properly packaging, palletizing, banding, and labeling all freight to withstand ordinary hazards of intermodal transit.
- Hazardous Materials: Shippers must notify IJR Logistics in writing prior to booking any Hazardous Materials (HAZMAT) or Dangerous Goods, providing accurate UN numbers, MSDS sheets, and emergency response contact details.
4. Pricing, Rates & Accessorial Surcharges
- Spot Quotes: Spot quotes are based on current equipment availability and lane conditions, valid for 7 calendar days unless otherwise specified in writing.
- Accessorial Charges: Detention fees, driver layovers, redelivery attempts, inside delivery, and residential liftgate accessorials will be billed in accordance with our standard published tariff schedule if incurred.
- Payment Terms: Invoices are due net 30 days from invoice date for approved commercial credit accounts. Unpaid balances accrue interest at 1.5% per month.
5. Cargo Liability & Claims Procedure
- Carrier Liability: The contracted carrier's liability for loss, damage, or delay is governed by 49 U.S.C. ยง 14706 (Carmack Amendment) for domestic surface freight and the Carriage of Goods by Sea Act (COGSA) for maritime movements.
- Claims Notification: Notice of concealed freight loss or damage must be filed in writing with IJR Logistics within nine (9) months of delivery (or within 15 days for concealed damage). Proof of Delivery (POD) signed with notation of damage is required.
6. Force Majeure & Limitation of Liability
IJR Logistics shall not be liable for any cargo delay, failure to deliver, or damage caused by acts of God, extreme weather, highway closures, port strikes, civil disturbances, acts of public authorities, or defects inherent in the goods.
7. Governing Law & Jurisdiction
These terms and conditions are governed by and construed in accordance with the federal transportation laws of the United States and the laws of the State of Illinois, with exclusive venue in the courts of Cook County, Illinois.
